Contest  Rules

 

Terms for Contests.

Entrant’s participation in any Contest is subject to and governed by the official rules set forth here, along with any additional guidelines (“Additional Terms”) outlined in the specific Contest listed on artimpactinternational.org or elsewhere (the “Specific Contest”). If there is a conflict between these official rules and the Additional Terms outlined in the Specific Contest, the Additional Terms will govern. 


1.1 Eligibility. 

Unless otherwise noted in the Additional Terms outlined in the Specific Contest, Art Impact® International Contests are open to legally registered businesses of the District of Columbia, Marylandand Virginia whose owners are the age of majority in their jurisdiction (“Entrants”). Contest supervisors and members of their immediate families are not eligible to participate or win. Contests are subject to all applicable federal, state, and local laws, rules and regulations. Void where prohibited. 


1.2 Social Media Disclosure. 

All Contests follow the guidelines of the social media channel on which the Contest is promoted. Contests are in no way sponsored, endorsed or administered by, or associated with the social media channel Entrants use to learn about or enter the Contest. Entrants are providing their information to Art Impact® International—and not to the social media channel—during the entry process. The information Entrants provide will be used for administering the Specific Contest and/or for marketing purposes in accordance with these Terms of Use and with Art Impact® International’s privacy policy


1.3 No purchase necessary to enter or win a contest offered by Art Impact® International. 

Entrants should review the Additional Terms for information regarding whether purchase is necessary for a Specific Contest, but contests will always have a free method of entry. 


1.4 Sponsor. 

Unless otherwise outlined in the Additional Terms for the Specific Contest, the Sponsor of the Contest is Art Impact® International, Inc., 6445 Luzon Ave. NW,  Suite 208, Washington, D.C., 20012 (“Sponsor” or “Art Impact® International”). 


1.5 Contest Period. 

The Contest begins and ends on the time and date outlined in the Additional Terms outlined in the Specific Contest, according to Sponsor’s internal time clock and time zone. All times for the events are listed in the local time where the event is located, whether Eastern Daylight or Eastern Standard Time. 


1.6 Only one entry per business per Contest. 

Unless otherwise noted in the Additional Terms outlined in the Specific Contest, or otherwise herein, Entrant may only enter one time. Multiple entries for Contests will not increase Entrant’s chances of winning (Entrant will still only receive one entry). If Entrant enters more than once in a Contest, only Entrant’s last eligible entry will be counted. 

Entrant may enter as many current Contests as Entrant is otherwise qualified to enter. In any given year, if Entrant’s winnings exceed US$600, Entrant’s winnings may be considered a taxable event by the IRS and Art Impact International may be required to issue Entrant a tax form 1099.

 

How to Enter.
 

In some cases, Entrant may be asked to enter through a social media channel. In that case, Entrant must have an account on that social media channel. All social media channels Art Impact International uses to launch Contests are free to join and Art Impact™ International makes commercially reasonable efforts to make sure Contests follow the guidelines set forth by the social media channel for promotions of that nature. In all cases where Entrant is required to place hashtags on the entry, all hashtags must be included or Entrant’s entry will not be eligible for the Specific Contest. In the event any Contest requires Entrant to upload a photograph of Entrant or show an image of Entrant, Entrant may upload any image that includes the requisite hashtags (so that Sponsor can find it), and Entrant will be entered in the Contest. 

Unless otherwise noted in the Additional Terms outlined in the Specific Contest, using non-private accounts only, ways to participate in the Contest are listed below: 


2.1 Twitter Contests. 

To participate, Entrants must have or create a non-private Twitter account (“Twitter account”). If Entrants already have a Twitter account, Entrants must sign in to their account. If Entrants are not existing members of Twitter, Entrants are required to follow the directions and join Twitter. When Entrants join Twitter, Entrants agree to the Twitter Terms of Service and Privacy Policy. Membership to Twitter.com is free. Using Twitter, during the Contest Period, Entrants must follow the Twitter account listed in the Additional Terms outlined in the Specific Contest and retweet Art Impact™ International’s Specific Contest tweet using the hashtag(s) specified in the Additional Terms outlined in the Specific Contest. 

(a) Retweet Contests. 

Retweet Contests require you to retweet a specific message outlined in the Specific Contest using your Twitter account. 

(b) Tweet Contests. 

Tweet Contests require you to tweet a unique message following the instructions on the Specific Contest. 


2.2 Instagram Contests. 

To participate, Entrants must have or create a non-private Instagram account (“Instagram account”). If Entrants already have an Instagram account, Entrants must sign in to their account. If Entrants are not existing members of Instagram, Entrants are required to follow the directions and join Instagram. When Entrants join Instagram, Entrants agree to the Instagram Terms of Service and Privacy Policy. Membership to Instagram.com is free. Using Instagram, during the Contest Period, Entrants must follow the Instagram account listed in the Additional Terms outlined in the Specific Contest, comment on Art Impact® International’s Specific Contest post using the hashtag(s) specified in the Additional Terms outlined in the Specific Contest, and tag a friend’s account. Regramming
is not allowed and is not sufficient for an entry into the Contest. In some cases, Entrants will be asked to post images on their own accounts and use a specified hashtag. 


2.3 Facebook Contests. 

To participate, Entrants must have or create a non-private Facebook account (“Facebook account”). If Entrants already have a Facebook account, Entrants must sign in to their account. If Entrants are not existing members of Facebook, Entrants are required to follow the directions and join Facebook. When Entrants join Facebook, Entrants agree to the Facebook Terms of Service and Privacy Policy. Membership to Facebook.com is free. Using Facebook, during the Specific Contest Period, Entrants must Like and/or Comment on the Facebook post listed in the Additional Terms outlined in the Specific Contest, or otherwise follow the directions stated within the Specific Contest and associated Additional Terms. 

 

2.4 Sponsor Website Contests.

 

To participate, Entrants must complete the survey and submit the answers.


2.5 Refer A Friend. 

In Specific Contests that include a refer-a-friend entry, Entrants may only receive a maximum of twenty-five (25) additional entries for posting the referral link on social media or through your dedicated email, and such referral link is clicked by that referred friend. In each case, you must add the hashtag #Contests to your post or email. For each person who clicks through on your link (up to five (5) people) and enters, you will receive five (5) entries. In the event a person has already signed up for the Specific Contest, you will not receive an entry. You may not post the referral link or tag friends on your Facebook page. Should you choose to participate in Refer-A-Friend Contests without using the social media option, please see steps below on 
Mail In Entry. 


2.6 
Mail In Entries. 

Should you choose to enter without referring a friend (in the case of specific refer-a-friend Contests), or without completing the specific requirement for entry in any Specific Contest, you may still participate in the Contests by choosing this Mail In Entry option. Entrants must mail in a 3x5 card including Entrant’s name, email address, phone number, and the name of the Specific Contest. Entries may be mailed to Art Impact® International, Inc., 6445 Luzon Ave. NW,  Suite 208, Washington, D.C., 20012, Attn: Contest Administrator. Mail-in entries must be postmarked by the Contests end date and received no later than five (5) days after the Contests end date. Entrants will receive a maximum of five (5) entries for each Mail-in. 

2.7 Surprise and Delight Promotions. 

From time to time, Art Impact® International gives gifts to people attending events, posting fun images, and just generally having a good time using the platform. There is no rhyme or reason for it, but an Art Impact® International team member might reach out to you if your post is public and give you something fun as a gift. Surprise and Delight gifts are for entertainment purposes as our way of recognizing your spirit. Those selected to receive Surprise and Delight gifts need not accept them. However, for those who accept Surprise and Delight gifts, the conditions outlined in section 3.6 of these official rules will apply.

Winning Contests, prices, and publicity.

3.1 Odds. 

The odds of winning depend upon the number of entries received. 


3.2 Contests Winner Selection. 

On or within forty-eight (48) hours of the end of the Contest Period, and unless otherwise outlined in the Additional Terms for the Specific Contest, one (1) Entrant will be selected at random by Sponsor or its representative from among all eligible entries received (the “Selected Entrant”).

3.3 Contest Winner Notification and Announcement. 

Unless otherwise noted, Selected Entrants will be contacted by way of a direct message to be given instructions on how to claim their prizes. Only one attempt to contact the Selected Entrant will be made. The Selected Entrant will be required to respond (as directed in the direct message) within seven (7) calendar days of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize and, in such case, Sponsor may—but is not obligated to—select an alternate Selected Entrant. 


3.4 Prize. 

Unless otherwise outlined in the Additional Terms for the Specific Contest, the prize will consist of five new works of art rotated every quarter within the same location for one calendar year (twelve months.)  Artwork delivered to the Selected Entrant physical business location will installed for exhibition in order to inspire staff and clients.  Arrangements are made via direct message on the social media platform of entry, via email, or telephone. The prize, the number of prizes, and the individual and total retail values of those prizes are listed in the Additional Terms outlined in the Specific Contest.  
Prize is limited to what is outlined in the Specific Contest. Anything not listed s not included and should not be implied. For instance, if the prize includes artwork being exhibited, transportation to and from the exhibition venue and other fees are not included. 


3.5 Publicity. 

By participating in the Contest, any Entrant irrevocably grants the Sponsor and their respective successors, assigns, and licensees, the right to use such Entrant’s, entry or submission, name, likeness, biographical information in any and all media for any purpose, including without limitation, commercial, advertising and promotional purposes as well as in, on, or in connection with the Contest or other promotions, and hereby releases the Sponsor from any liability with respect thereto, unless prohibited by law. 


3.6 Prize Conditions. 

In cases where the prize in a Specific Contest exceeds US$600, the Selected Entrant may also be required to complete additional paperwork, and may be required to provide Sponsor with their social security number and may be issued a tax form. In the event of a dispute about the identity of an Entrant, each entry will be declared made by the name and relevant information submitted at time of entry. Sponsor will not make multiple attempts to contact Selected Entrant. 

No substitution, transfer, or cash redemption of prize permitted, provided however that Sponsor reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. Unless otherwise outlined in the Additional Terms for the Specific Contest, no travel or transportation to or from any art exhibition location is included in the prize. Selected Entrants are responsible for all travel arrangements necessary.

Artwork must be insured under Entrant’s business insurance policy for theft or damage.

Conditions of Participating.

 

By participating, Entrants agree to be fully and unconditionally bound by these terms, the Additional Terms for the Specific Contest, and the decisions of Sponsor, and waive any right to claim ambiguity in the Contest. Any portion of the Contest may be canceled, suspended, and/or modified, in whole or in part, if in Sponsor’s opinion any fraud, technical failure, or other factor beyond Sponsor’s control impairs the integrity or proper functioning of the Contest. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of any Contest or Sponsor’s website, to be acting in violation of these terms, or to be acting in an unsportsperson-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten, or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Entrants may not enter with multiple identities or use any automated system, bot, or other device or artifice to enter or obtain more than the maximum number of qualified entries. Sponsor reserves the right at its sole discretion to terminate any Contest and, if terminated, at its discretion, select the winner(s) either by applying the judging criteria or, if a Contests, in a random drawing from among all eligible, non-suspect entries received prior to action taken.

 

Limitation of Liability.

If for any reason an entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, the Entrant's sole remedy is another entry in the same Contest during the Contest Period listed in the Additional Terms outlined in the Specific Contest. Entrants also agree to release, discharge, indemnify, and hold harmless Sponsor and each of its respective officers, directors, employees, representatives, and agents (collectively “Releasees”) from and against any claims, damages, disability, attorneys' fees, and costs of litigation and settlement, as well as any liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from: (i) use, redemption, acceptance, possession, ownership, or misuse of any prize, (ii) participation in any activity, event, or excursion offered in connection with the prize, (iii) use of any facility, service, and/or accommodation related to the prize, or (iv) participation in any Contest-related activity or participation in any Art Impact® International Contest. The Releasees shall not be liable for: (i) late, lost, delayed, misdirected, incomplete unreadable, inaccurate, garbled, or unintelligible entries, communications, or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical malfunctions, lost connections, disconnections, delays, or transmission errors; (iii) data corruption, theft, destruction, or unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses, or damages of any kind caused by the prize or resulting from acceptance, possession, or use of a prize, or from participation in the Contest; or (v) any printing, typographical, administrative, or technological errors in any materials associated with the Contest. Without limiting the generality of the foregoing, Releasees are not responsible for computer malfunctions, network connections, email delivery problems, systems failure or incompatibility, typographical, technical or key-stroke errors, or interruptions in internet service, and for incomplete, illegible, misdirected, misprinted, late, lost, damaged, or stolen notifications. In the event Sponsor is prevented from continuing with a Contest as contemplated herein by any event beyond its control, including but not limited to fire, flood, earthquake, explosion, labor dispute or strike, act of God or public enemy, or any federal, state or local government law, order, or regulation, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated end date, Sponsor will (if possible) select the winners from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

 

Privacy.

All personal information collected by Sponsor will be used for administration of the Contest. In addition, Entrants will receive email correspondence from, or on behalf of Sponsor subject to Sponsor’s privacy policy. Sponsor uses reasonable commercial efforts to comply with Federal CAN-SPAM guidelines and to supply information to entities that comply with CAN-SPAM guidelines, and Entrants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email. Any questions regarding privacy matters should be directed to support@artimpactinternational.org.com. Please refer to Sponsor’s privacy policy for important information regarding the collection, use and disclosure of personal information by Sponsor.

 

Disputes and Jurisdiction.

Disputes regarding these terms will be governed by the internal laws of the District of Columbia. Decisions of Sponsor are binding and final. No claimant in any dispute involving Sponsor shall be entitled to claim or obtain indirect, punitive, incidental or consequential damages. Sponsor’s failure to enforce any provision in these Official Rules shall not constitute a waiver of that provision.

 

Winner’s List and Contest Rules.

To obtain a copy of Contest Official Rules or a winner’s list after the end of the Contest Period, email winners@ArtImpactInternational.org. To obtain the names of the winner in the Contest, mail a self-addressed stamped envelope to Art Impact® International, Inc., 6445 Luzon Ave. NW,  Suite 208, Washington, D.C., 20012, Attn: Contest Administrator no later than ninety (90) days after the end of the Contest. Please specify the date on which the Contest began, and the name of the specific Contest.
